How to Get an Open Work Permit as a Spouse or Partner of a Canadian Citizen

Understanding the 2023 Public Policy

 The May 2023 Public Policy was introduced with the aim of streamlining the immigration process and making it more accessible for potential immigrants. Previously, only those who were in Canada and were applying through the in-Canada spousal sponsorship class were able to avail themselves of an open work permit.

 

This policy allows that applicants under the Family Class (meaning those who applied as out of Canada applicants) can also apply for an open work permit.

 

Eligibility Criteria

Before embarking on the process of preparing your open work permit application, it's crucial to understand if you meet the eligibility criteria under the new policy.

 

Under the 2023 Public Policy, you need to be either already in Canada on a valid temporary status (worker, visitor or student). You need to have already have a pending permanent residency application under the Federal Sponsorship programs.

 

Note on Temporary Status in Canada

I would be remiss to not mention that Immigration Canada’s recent update also noted that those who are outside of Canada with a pending Federal Family Class application can now apply for a TRV (visit visa) and be processed within 30 days. The government has also announced that it aims to approve 90% of applications for TRVs from those who are being sponsored by a spouse or partner in Canada. As such, this is often the first step in order to pursue the new open work permit for sponsored spouses.

 

Preparing Your Application

You’ll need to put together a complete application and submit online through the government’s secure GCKey. Your application should include:

1.     Passports

2.     Proof of immigration status in Canada

3.     Photo

4.     Proof of marriage or common-law status

5.     Evidence of submitted Permanent Residency Application

6.     Evidence of relationship with sponsor

7.     Ties to home country (family and assets in the home country)

8.     Application forms (Imm5710)
