If you're thinking about flagpoling to handle your immigration paperwork, it's important to understand the current rules and restrictions. Let's dive into what flagpoling is, and whether you should use this process to speed up the processing of your Canadian permit.
What is Flagpoling?
Flagpoling is when someone leaves Canada only to immediately re-enter to deal with their immigration status. It’s called flagpoling because you literally drive to the border, turn around the flagpole, and come back to get your paperwork processed.
CBSA Restrictions on Flagpoling
This year, CBSA has made it harder to flagpole by limiting the hours and types of applications they process at the border. Here are some key changes:
1. Hours of Operation: Many border crossings now have specific hours during which they process immigration applications. These hours are often limited to certain days of the week.
2. Types of Applications: Not all applications can be processed at the border anymore. For example:
Post-Graduation Work Permit (PGWP): You can no longer apply for a PGWP at the border.
Open Work Permits: Applying for an open work permit at the border is also a no-go.
Visa Requirements and Removal Orders
Did you know you don’t need a valid visa (TRV) to flagpole? However, some CBSA officers might not be aware of this rule and could issue a removal order. This means they ask you to leave Canada, which can complicate your situation.
Choosing the Right Border Crossing
Not all border crossings are equal when it comes to flagpoling. Some are more lenient, while others are known for being strict. Here’s a quick guide:
Ontario and British Columbia Crossings: These are generally more open to flagpoling and less likely to issue removal orders.
Saskatchewan and Manitoba Crossings: Be cautious here. Officers at these crossings are known for issuing refusals and sometimes even departure orders.
Quebec border: You have to call ahead and make an appointment.
