Navigating the Process of Bringing Technicians to Canada: A Guide for Employers

I understand the challenges businesses face when bringing technicians to Canada for after-sales service or short-term technical work. Whether it's ensuring eligibility under the Business Visitor Visa Program or obtaining the appropriate work permit, navigating the immigration process can be complex. In this blog post, I'll provide guidance on how to bring technicians to Canada, outlining the eligibility criteria and available pathways.

Bringing Technicians as Business Visitors:

Technicians who are coming to Canada for after-sales service purposes can often enter under the Business Visitor Visa Program. However, it's essential to ensure that the original contract includes an after-sale clause or allows for an extension to cover the duration of the technician's stay. This clause demonstrates the necessity of the technician's presence in Canada for post-sales support, aligning with permissible business visitor activities.

Consideration for C-13 Work Permit:

If after-sales entry is not available, employers may explore the option of obtaining a C-13 work permit for technicians. The C-13 work permit is LMIA exempt and allows for short-term technical work, typically for 30 days or less. This option is suitable when the service of repair personnel is required due to specific knowledge, absence of commercial presence by the manufacturer (OEM), and the potential impact on Canadian jobs if the equipment is not repaired promptly.

Last option: Applying for an LMIA:

In cases where neither after-sales entry nor the C-13 work permit is applicable, employers may need to obtain a Labour Market Impact Assessment (LMIA). An LMIA is a document issued by Employment and Social Development Canada (ESDC), confirming that hiring a foreign worker will not negatively impact the Canadian labour market. The LMIA process involves demonstrating efforts to recruit Canadian workers and satisfying specific criteria outlined by ESDC, this can be a lengthy process and therefore we try to avoid this last step at all costs.
